IOWA
HF 767 – Private Sector Employee Drug Testing
This new law is effective July 1, 2025 and modifies employers’ and employees’ rights related to drug testing of employees. Modifications included a definition change in safety-sensitive-positions defined by the employer, expansion of allowable methods to notify employees of test results, allows employees to request a second test and requires employers to pay for it, and puts burden of proof on employees related to any employer violations in drug testing.
HF 607 – Unemployment Insurance Tax
Also effective July 1, 2025, this reduces the default Unemployment Insurance tax rates for new businesses and lowers the taxable wage base. Iowa employers should see a reduction in their payroll taxes by 40-60% going forward.
NEBRASKA
LB265 – Manufacturing Modernization and Workforce Development Pilot Investment Act
Part of this bill, signed into law June 4, provides a one-time state grant up to $50,000 to eligible Nebraska manufacturers to adopt smart technologies and training to boost productivity. Total program funding is capped at $250,000. Applicants can apply starting October 1, 2025 and must not have started the project before applying.
LB415 – Modifications to the Nebraska Healthy Families and Workplaces Act (Paid Sick Leave)
Clarifying the Paid Sick Leave law passed by last year’s ballot initiative, this new language added details for employers to comply with the new law more easily. Clarifications include definitions for which workers are excluded (contractors, minors under 16, owner-operators, etc.), specifying that employers with 10 or fewer employees are excluded, employees begin accruing after 80 hours worked, and more.
LB297 – Change provisions relating to the combined tax rate under the Employment Security Law (Unemployment Insurance Tax)
This new law for the 2025 tax year revises the methodology for computing unemployment insurance tax rates. The details are a bit complicated, but the end effect is lower payroll taxes for Nebraska employers.
